1. Definitions:

Promoter: Scottish Pacific Business Finance PTY LTD (ABN 79 008 636 388) of 25 Martin Place, Sydney NSW 2000 Australia and other each entity related to Scottish Pacific Business Finance PTY LTD to which a Deal is referred.

Claimant: The Promoter’s referral partner operating in Australia, either as an individual or as a business entity, who meets the eligibility criteria outlined below.

Deal: An opportunity for the Promoter to provide a finance facility to an entity referred to the Promoter by the Claimant which entity does not have a finance facility with the Promoter at the time of the referral.

Offer: The ‘Make the Switch to ScotPac’ promotion described in these Terms and Conditions, under which eligible Claimants may receive a Reward for referring and settling a qualifying Deal during the Offer Period.

Reward: A choice of either iPhone 16 Pro 256GB or Samsung Galaxy S25+ 512GB smartphone. The specific phone model may be subject to change at the Promoter’s discretion. The Reward is strictly limited to the one (1) smartphone chosen by the Claimant and does not include any carrier contract, internet, telephone or other transmission connections, or other accessories.

Offer Period: the period between 01 April 2025 and 30 June 2025. The Promoter reserves the right to extend, amend, or withdraw the promotion at its sole discretion.

 

2. Eligibility:

To qualify for the Reward:

a) the Claimant must Refer a Deal to ScotPac within the Offer Period that successfully settles within six (6) months from the date of referral; and

b) the Deal referred by the Claimant must meet the minimum facility limit requirements as outlined below:

  • For Asset Finance: AUD $100,000 minimum facility limit applies
  • For all other ScotPac products: AUD $30,000 minimum facility limit applies; and

c) The Claimant must meet one of the following conditions:

  • It is the Claimant’s first settled Deal with ScotPac OR
  • The Claimant has not referred a Deal (which meets the Promoter’s applicable sales and credit criteria) to ScotPac in the 12 months prior to 1 April 2025 (i.e., the last referred Deal was before 1 April 2024).

 

3. How to claim:

The Promoter will endeavour to contact eligible Claimants within 10 business days of Deal settlement to confirm their choice of iPhone 16 Pro 256GB or Samsung Galaxy S25+ 512GB. The Reward will be dispatched to the Claimant within 30 business days of confirmation, subject to availability. Claimants can contact [email protected] for any questions regarding their Reward.

 

4. Reward limitations:

  • The Reward cannot be transferred, assigned, exchanged for cash, cheque, or any alternative product or service by the Claimant.
  • Each Claimant is eligible to receive one (1) Reward only under this Offer, regardless of the number of Deals referred or settled during the Offer Period.
  • The Promoter reserves the right to substitute the Reward with a product of equal value (up to AUD $2,000 including applicable taxes) if the chosen phone model is unavailable.

 

5. Discretion:

The Promoter will determine eligibility and Reward distribution, and its determination is final and binding on the Claimant.

 

6. Privacy:

The Promoter collects personal information (PI) in order to conduct the Offer and may, for this purpose, disclose such PI to third parties, including but not limited to agents, contractors, service providers, Offer suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this PI. The Promoter’s Privacy Policy applies to this promotion and can be accessed at https://www.scotpac.com.au/privacy-policy/.

 

7. Limitation of liability:

The Promoter is not responsible for any loss, damage, or delay arising from:

  • The Claimant’s failure to provide accurate contact or delivery details.
  • Delivery delays beyond the Promoter’s control.
  • Any technical errors or disruptions affecting Deal settlements or claim processing.
  • Any manufacturing or other defect in the Reward, or any use by the Claimant of the Reward.

The Claimant acknowledges that the Promoter is not the supplier or manufacturer of the Reward. The Promoter offers no warranties in relation to the use or suitability of the Reward and the Claimant releases and indemnifies the Promoter with respect to any claims arising from the Claimant’s possession or use of the Reward. The Reward does not come with any additional warranties beyond those provided by the manufacturer of the Reward.

 

8. Governing law, variation of Terms and Conditions and dispute resolution:

  • These Terms & Conditions are governed by the laws of New South Wales, Australia.
  • Any disputes arising in connection with this Offer shall be subject to the exclusive jurisdiction of the courts of New South Wales.
  • The Promoter reserves the right to vary these Terms and Conditions without notice.
